TERMS & CONDITIONS

 

General


These Terms & Conditions apply to all photography services provided by Markus Andjelic (hereinafter referred to as “Photographer”).


By booking photography services, the client agrees to the following terms.


Booking & Payment


Bookings are considered confirmed once both parties have agreed to the requested service and signed the contract.


For selected projects or touring bookings, the Photographer may require a deposit to secure the requested dates.


Invoices must be paid within the payment period stated on the invoice.


Additional expenses such as:


  • travel costs
  • accommodation
  • parking fees
  • special requests
  • additional editing requests


may be charged separately if agreed beforehand.



Late payments may result in delayed delivery of final images.


Delivery


Final edited images will be delivered digitally via online gallery unless otherwise agreed.

Delivery times may vary depending on:


  • workload
  • event size
  • tour schedules
  • travel conditions


The amount of delivered images depends on the type, duration and conditions of the event.


The Photographer is not responsible for delays caused by circumstances beyond reasonable control.


The Photographer is not responsible for technical issues caused by third-party platforms or services.

Editing & Artistic Style


The client acknowledges that the Photographer’s work is created in an individual artistic style.


Final image selection and editing remain at the Photographer’s discretion.


RAW files and unedited material will not be delivered unless otherwise agreed in writing.


Minor editing adjustments may be requested within 7 days after delivery.


Additional editing requests may be charged separately.


Images may not be heavily altered, edited or filtered without prior permission of the Photographer.

Usage Rights


The client receives non-exclusive usage rights for social media and promotional purposes unless otherwise agreed.


 This includes:


  • Instagram
  • TikTok
  • Facebook
  • story posts and reposts
  • promotional use
  • press use


Commercial use including:


  • merchandise
  • paid advertisements
  • sponsorship campaigns
  • album covers
  • print campaigns
  • transfer to third parties


requires separate written permission.

Copyright


All images remain the intellectual property and copyright of the Photographer.


The Photographer may use created content for:


  • portfolio
  • website
  • social media
  • self-promotion


unless otherwise agreed in writing.


Credits


Photographer credit is appreciated whenever reasonably possible when publishing images.


Exclusivity


The Photographer may work with multiple artists, venues or clients unless exclusivity has been agreed upon separately in writing.

Cancellation


Cancellation terms may vary depending on the type and scope of the booking and will be defined in the individual agreement or contract.


Any already incurred expenses such as travel bookings, accommodation or other non-refundable costs must be reimbursed by the client.


Liability


The Photographer is not liable for:


technical failures

venue restrictions

lighting conditions

weather conditions

circumstances beyond reasonable control

actions of third parties


that may affect the final result or delivery.


In case the Photographer is unable to attend due to illness, emergency or circumstances beyond reasonable control, all reasonable efforts will be made to find an alternative solution.


The Photographer’s liability is limited to the amount paid for the booked service.


While all reasonable efforts are made to safely store and back up image files, the Photographer is not liable for unforeseen data loss caused by technical failure or circumstances beyond reasonable control.

Final Provisions


Any amendments or additional agreements must be made in writing.


The Photographer reserves the right to update these Terms & Conditions at any time.


Austrian law shall apply.
